Terms of Service

These Terms of Service (“Terms”) govern your use of getnicepic.com and the NicePic photo-editing services (the “Service”). NicePic is operated by Chengyao Duan. By using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

1. The Service

NicePic lets you upload photos and edit or transform them with artificial intelligence using ready-made tools or your own instructions. We offer a free tier with a daily number of edits, and we plan to offer paid credit packs. We may add, change or remove features over time.

2. Who can use it

You must be at least 13 years old (or the minimum age required in your country). If you're under the age of majority where you live, you need a parent or guardian's permission, and purchases must be made by an adult.

3. Your photos and results

  • You keep all rights to the photos you upload (“Inputs”). As between you and us, you also own the images generated for you (“Outputs”), to the extent the law allows.
  • You give us a limited permission to store, process, transmit and display your Inputs and Outputs only to provide the Service to you — including sending them to our AI providers to create your edits. We don't use them to train AI models or for advertising.
  • You're responsible for your Inputs. You must have the rights to the photos you upload and permission from the people who appear in them to edit their images.

4. What you must not do

You agree not to use the Service to:

  • create or upload any sexual content involving minors — we report it to the authorities;
  • create nude, sexual or intimate images of a real person, or any image of a real person without their consent that could harm them;
  • impersonate, defame, harass or deceive anyone — including passing off edited images of real people as authentic, or creating fake documents or IDs;
  • infringe anyone's copyright, trademark, privacy or publicity rights;
  • create content that promotes violence, hatred or illegal activity;
  • get around usage limits, scrape, reverse-engineer, overload or attack the Service, access it with bots, or resell it without our written permission.

We may refuse requests, remove content and suspend or end access to the Service if we believe these rules have been broken. Requests are also screened automatically for safety.

5. AI-generated results

Outputs are created automatically and can be inaccurate, unexpected or similar to results created for other people. Review them before you use them, and don't rely on them where accuracy matters. When you share edited images of real people, don't present them in a way that could mislead others into believing they're unedited.

6. Free edits, credits and payments

  • Free edits are limited per day and reset daily at 16:00 UTC. Unused free edits don't carry over.
  • Paid credit packs, when available, are one-time purchases in US dollars; taxes may apply. One credit is used for each generated image. Edits that fail, time out or are blocked don't use credits.
  • Credits are a license to use the Service: they have no cash value, can't be transferred or resold, and don't expire while the Service is running. If we shut down the paid Service, we'll refund unused credits.
  • Payments are processed by a third-party payment provider, whose terms also apply. Refunds follow our Refund Policy (14 days for unused credits).

7. Our content

The Service itself — the NicePic name and logo, site design, software and example images — belongs to us or our licensors. These Terms don't give you any rights to it except to use the Service as offered.

8. Ending your use

You can stop using the Service at any time. We may suspend or end your access if you break these Terms or if we need to in order to comply with the law. Sections that by their nature should survive (such as ownership, disclaimers and limits of liability) will survive.

9. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we don't promise the Service will be uninterrupted, error-free or produce any particular result.

10. Limitation of liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US$50. Nothing in these Terms limits liability that can't be limited by law.

11. Indemnity

You agree to indemnify us against claims, losses and costs arising from your Inputs, your use of Outputs, or your breach of these Terms.

12. Governing law

These Terms are governed by the laws of the People's Republic of China, without regard to its conflict-of-law rules. If you're a consumer, you keep any protections given to you by the mandatory laws of the country where you live.

13. Changes to these Terms

We may update these Terms. We'll change the date at the top, and for material changes we'll post a notice on the site. If you keep using the Service after changes take effect, the new Terms apply.
